There are a few things you can do to stop a power of sale or foreclosure.
First get any documents that a lawyer has sent to you.
Determine if the lender just wants to be paid or is the lender taking your house.
Call the lender tell them you are trying to get them their money.
If you need a lawyer or advice go to our site.

As far as I can see, no one has explained exactly what the real situation is on a mortgage, mostly, I think, because few people bother to analyse the documents they sign. maybe this website will educate you.

Hi David

You are quite correct, there are very few people that will explain the foreclosure or power of sale process to the home owner. Only a real estate lawyer or a very specialized mortgage broker like myself has the experience to analyze the documents and give an informed decision. There are many different documents such as : "Notice of Sale Under Mortgage", Statement of Claim", Writ of Possession", "Eviction Notice", Judgements, "Court Orders", "Executions". There is also the time frame that relates to each document.

We try to give everyone the best possible information as it relates to their situation, my best advice is call me at 416-499-2122 to discuss options if you are facing a foreclosure or power of sale.

We have also noticed that in GTA areas such as Toronto, Mississauga, Brampton and Newmarket and Oshawa where house prices have increased the banks are not as aggressive. I believe the reason is that rising house prices gives the property more equity and the banks feel more comfortable with the risk.
